As you may be aware, Community Windpower Limited (CWL) recently appealed against the Court of Session decision in favour of the Council.

The three Appeal Court judges who heard the appeal did not make a formal decision after hearing from CWL and the Council, and stated that they wished time to consider matters further before issuing a decision at the end of this week. However, they did temporarily suspend the Stop Notice that the Council had previously issued on 9 August 2017, until their decision was issued. This does not mean that CWL’s appeal will be successful. But, it has the effect of allowing CWL to carry out further works within the wind farm site. However, the appeal court advised CWL that they should not do any works on the wind farm site that could affect the private water supplies of relevant properties.  Further information to follow shortly.
