we were contacted by a member of the public who had attended the Hearing and was happy to supply us with a summary of the proceedings.

Earlier this week the parties agreed terms on which the claim would be withdrawn.  A draft judgement had been prepared but not circulated so no-one knew the outcome.  Both parties asked the Judge not to deliver the judgement in case it undermined the agreement and lead to further litigation  which it was said may result in uncertainty for the CfD scheme.  He agreed to an application from both parties to not deliver judgement and gave his reasons as

·         Public interest nature of the proceedings

·         Wider interest in resolving  the issues

·         Interest in climate change targets

This justified not delivering judgement and allowing the claim to be withdrawn.
