Below, you will find the Opinion of the Court delivered by Lord Brodie in the Appeals by Community Windpower Ltd and FIM against the Scottish Ministers and East Ayrshire Council in relation to Sneddon Law Wind Farm in East Ayrshire.
Conclusion: We have considered each of the material attacks made by the appellants on the Decision. We have found none of them to be well-founded.We shall refuse the appeals.
Construction was stopped after local residents raised concerns about impa
cts on private water supplies. They were not involved in the JR. This appeal was against the Reporter’s decision which can be read here
NOTE: CWP /Sneddon Law Community Wind Company have, without waiting for this decision, recently applied to renew their planning permission of October 2014 and avoid compliance with condition 36 under s.42 of the 1997 Planning (Scotland) Act, which would otherwise require the developer to provide mitigation and monitoring for the ‘at risk’ 22 PWS affected by this development.
