We have been informed that at least five Sec 42 applications to increase tip heights on already consented but not yet built windfarms, have been withdrawn due to the Finney judgement, three of which are in Dumfries & Galloway. The Council has said it will not accept any further height variation applications unless Holyrood provides more clarity.
