There will be a Substantive Hearing in the Court of Session on Friday 23 October 2020 before Lord Tyre in the case between Energiekontor and the Ministry of Defence regarding the Eskdalemuir seismic monitoring station noise budget. If the developer is successful it could open the door to new policy freeing up more than 1GW of wind capacity in the south of Scotland. MoD policy reserves capacity in the noise budget for larger projects at scoping rather than at the planning stage. Energiekontor is asking the court to declare the approach unreasonable, unlawful and beyond its powers.
